(Indemnification Clause)

By using this website and engaging in any transactions related to the purchase of tiny mobile smart homes, garden homes, or any other products sold herein, the Client agrees to the following indemnification terms:

1. No Liability To The Website Owner & Referring Party: The Website Owner & Referring Party (including but not limited to affiliates, partners, influencers, or any third party directing the Client to this website) shall have absolutely no liability whatsoever in connection with the sale, purchase, delivery, Quality, use, or any other aspect of the transaction between the Client and the Direct Seller (NESTRON) of the product(s). The Referring Party is not a party to the transaction and assumes no responsibility for the product(s), its quality, performance, or any claims arising from the transaction.

2. Sole Responsibility of Client and Direct Seller: The transaction is solely between the Client and the Direct Seller (NESTRON) of the product(s) listed on this website. The Client acknowledges and agrees that the Website Owner & Referring Party is not involved in the sale, fulfillment, or any other aspect of the transaction beyond potentially directing the Client to this website. The Client further agrees that the Website Owner & Referring Party shall not be held liable for any damages, losses, claims, Quality issues, or expenses arising from the purchase, use, or misuse of the product(s).

3. Indemnification by Client: The Client agrees to indemnify, defend, and hold harmless the Website Owner & Referring Party from and against any and all claims, liabilities, damages, losses, costs, quality issues, or expenses (including reasonable attorneys' fees) arising out of or related to the Client’s purchase, use, or misuse of the product(s), or any breach of this agreement. This indemnification obligation shall survive the completion of the transaction and the termination of any relationship between the Client and the Direct Seller.

4. No Warranty or Representation by The Website Owner & Referring Party: The Website Owner & Referring Party makes no warranties, representations, or guarantees regarding the product(s) sold on this website, including but not limited to its quality, safety, suitability, or compliance with any laws or regulations. Any such warranties or representations are solely those of the Direct Seller (NESTRON).

5. Acknowledgment of Understanding: The Client acknowledges that they have read, understood, and agreed to this indemnification clause. The Client further acknowledges that they are entering into a transaction solely with the Direct Seller (NESTRON) and that the Website Owner & Referring Party has no involvement or liability in the transaction whatsoever.

6. Governing Law: This indemnification clause shall be governed by and construed in accordance with the laws of [U.S.A & CANADA Jurisdiction], without regard to its conflict of law principles.

7. The Website owner / Referring party Agent shall not be held liable or responsible for any issues, problems, or dissatisfaction that may arise post-sale, including but not limited to any claims related to non-delivery, defects, or failure of the product to meet the client’s expectations. In the event of legal action initiated by a client, including but not limited to lawsuits due to dissatisfaction or non-delivery, the Website owner & Referring party Agent shall be fully exempt from any liability. All responsibility, including legal, shall rest solely with Nestron. Any disputes or claims will be handled directly between the client and the Company (NESTRON).

By proceeding with the purchase and checking out on this website, the Client confirms their acceptance of this indemnification clause and agrees to be bound by (All) of the terms & conditions listed & stated above.
